About Prenups

Short answer, YES. We get asked this question all the time, because many doubt whether prenuptial agreements are enforceable based on misinformation they have read, extremely rare court cases, and movie fiction.  

A well-drafted prenuptial agreement should be enforceable if it is prepared and executed in accordance with the applicable laws of the state where you live. Most states have adopted the Uniform Premarital Agreement Act (UPAA or UPMAA), making prenups valid and enforceable if done correctly.

Most attorneys recommend that each side retain independent legal counsel, and we tend to agree. But we make no strict recommendation either way, except that you should comply with your state’s laws. Some states will require it.

Many of our clients are trying to keep their legal costs down and frequently the couple waits until after our phone call to review the actual prenup and answer questions to decide whether the other party should retain their own counsel. We welcome questions from both parties to the marriage because we want couples to feel confident that they understand the prenup we’ve prepared for them. That said, both parties to a prenup must fully understand the document, its terms and the legal implications of those terms.

We can help. We are typically able to source another attorney from our vast network to work with your spouse-to-be. The additional charge for this service will range from $250-350 depending on your location and the years of experience of a particular attorney.

 

No. A premarital agreement is a private document between a marrying couple, and no one else. A premarital agreement does not get filed with any local, state or federal agency, and couples often choose to keep the terms confidential. You should always keep a hard and soft (digital) copy of your signed prenuptial agreement, and we will maintain a digital copy for you as well. But the document will only be referenced and only become effective, in the event things go wrong. It’s a bit like a Last Will in that regard.
